The first Arizona medical marijuana law was passed as a result of  Arizona voters approval of a citizen’s initiative, Proposition 203 on November 2, 2010.   As it stands the current Arizona medical marijuana law removes state-level criminal penalties on the use and possession of marijuana by patients who have “written certification” from their physician that marijuana may alleviate a patient’s condition. The law officially took into effect in April 2011 and still stands today. Dispensaries started opening in Arizona in 2012.

Proof of residency in the state of Arizona is required to get a medical marijuana card in Arizona.  

According to the AZ Medical Marijuana Law, the following conditions are deemed suitable for obtaining medical marijuana include but are not limited to: 

  • Cancer

  • Positive status for HIV or AIDS
  • Hepatitis C
  • Amyotrophic lateral sclerosis (Lou Gehrig’s disease)
  • Crohn’s disease,
  • Agitation of Alzheimer’s disease 

Or any chronic or debilitating medical condition or its treatment that produces one or more of the following:

  • Cachexia or wasting syndrome,
  • Chronic pain
  • Severe nausea
  • Seizures including those characteristic of epilepsy
  • Spasms including those characteristic of multiple sclerosis
  • Persistent muscle spasms or seizures
  • Severe nausea

AZ Medical Marijuana Law – Possession and Use

Patients (or their primary caregivers) may legally possess no more than two and one-half ounces of usable marijuana, and may cultivate no more than twelve marijuana plants in an “enclosed, locked facility.” The law establishes a confidential state-run patient registry that issues identification cards to qualifying patients.

State-licensed dispensaries may produce and distribute medical marijuana on a non-profit basis to qualified patients and caregivers. Arizona medical marijuana dispensaries must also comply with AZDHS standards to ensure accurate record-keeping and adequate security measures.
